AMARIE DIZAJN D.O.O. ZA USLUGE, a company that deals with fashion design and through its website amarieofficial.com provides service information and an online store (web shop).

GENERAL TERMS AND CONDITIONS OF USING THE WEBSITE AND WEBSHOP SERVICE

1. GENERAL TERMS AND CONDITIONS

1.1 Terms of service govern the use of internet pages and internet shops by the user.

1.2 In these General Terms and Conditions, the terms in bold letters shall bear the following meaning:

  • For the purpose of these Terms and Conditions A’MARIE refers to the company AMARIE DIZAJN D.O.O. ZA USLUGE having its registered office at Zagreb, Gundulićeva 19, registered with the court register of the Commercial Court in Zagreb, PIN (OIB) 93092892560.

  • Website means all web pages owned by A’MARIE.

  • User or Buyer means every natural person accessing the Website, whether they are a Registered User or a Guest User.

  • Registered User is a natural person who has created an account on the Website.

  • Guest User is a natural person making a purchase without creating an account.

  • WEBSHOP service is every service that enables Users to purchase A’MARIE products through the Website.

By accessing the Website via appropriate technological means of access and by using the Website, the User undertakes to comply with these General Terms and Conditions and agrees to be subject to the provisions of these General Terms and Conditions.

2. LIMITATIONS OF USE AND LIABILITY

2.1 By accessing our Website, the User undertakes not to:

  • use the Website in any way that is contrary to the regulations currently in force;

  • place on the Website or distribute through the Website any content which is contrary to the regulations, including, but not limited to harmful, threatening, disturbing, vulgar, pornographic content, discriminatory content conducive to hatred and racial hostility or content which violates other people’s rights and interests;

  • alter, delete or destroy any data on the Website;

  • use the Website to violate rights of third parties, including confidentiality, intellectual property rights or other rights or interests of third parties;

  • post or share through the Website any illegal software, including, but not limited to viruses, spyware, Trojans, spams or the like.

2.2 Documents, data and information published on the Website may not be reproduced, distributed or in any way used for commercial purposes without an express consent of A’MARIE.

2.3 By using the contents of the Website, the User accepts all risks arising from the use of the Website and agrees to use the contents of the Websites exclusively for personal purposes and at his/her own responsibility.

2.4 A’MARIE waives any liability for any actions of Users arising from the use or misuse of the contents of the Website.

2.5 Prices are subject to change. A’MARIE reserves the right to change the price of its products, to correct pricing errors and/or to cancel an order due to pricing errors. 3. INTELLECTUAL PROPERTY PROTECTION

3.1 The User accepts that the entire contents of the Website are the exclusive property of A’MARIE or its authorized persons.

3.2 Use of the Website provides the User with limited, non-exclusive, non-transferable and revocable permission to use the Website contents by browsing them for personal use.

3.3 The User is especially not entitled to download, duplicate, alter, edit, distribute, show, delete, send, sell, resell, adjust, change the content, create derivatives, incorporate it in other web pages or media or use it in any way other than for personal home use, respecting the third party copyrights.

4. PROTECTION OF PERSONAL DATA

4.1 The collection and processing of personal data are governed by our Privacy Policy. Please refer to the Privacy Policy page for detailed information on how we handle your data, including data sharing with our partners (Shopify, CorvusPay, etc.).

5. SECURITY OF ONLINE PAYMENTS

When making a payment on our web shop, you use CorvusPay – an advanced system for secure acceptance of payment cards on the Internet.

The CorvusPay system ensures complete privacy of your card and personal data from the moment you type them into the CorvusPay payment form. Payment data is forwarded encrypted from your web browser to the bank that issued your card. Our store never comes into contact with your complete payment card data. Also, the data is inaccessible even to CorvusPay system employees. An isolated core independently transmits and manages sensitive data, keeping it completely safe.

The form for entering payment data is secured by an SSL transmission cipher of the greatest reliability. All stored data is additionally protected by encryption, using a cryptographic device certified according to the FIPS 140-2 Level 3 standard. CorvusPay satisfies all requirements for safe online payment prescribed by the leading card brands, operating in compliance with the PCI DSS Level 1 norm – the highest security standard of the payment card industry. When paying with cards included in the 3-D Secure program, your bank validates the validity of the card and additionally confirms your identity using a token or a password.

CorvusPay considers all collected information as secret and treats it accordingly. The information is used exclusively for the purposes for which it was intended. Your sensitive data is completely secure, and its privacy is guaranteed by state-of-the-art protection mechanisms. Only data necessary for performing the work is collected, in accordance with the demanding prescribed procedures for online payment.

Security controls and operating procedures applied to our infrastructure ensure the immediate reliability of the CorvusPay system. In addition, by maintaining strict access controls, regular security monitoring and in-depth checks to prevent network vulnerabilities, and planned implementation of information security provisions, the level of system security is permanently maintained and improved by protecting your card data.

6. USING THE WEBSHOP SERVICE (REGISTRATION AND GUEST CHECKOUT)

6.1 Use of the WEBSHOP Service is available to Registered Users and Guest Users who are of age and have full legal capacity.

6.2 Registration is optional. The User may choose to create an account or proceed as a guest.

6.3 Upon successful registration, the Registered User is assigned a user name and a password. The Registered User must keep his user name and password secret and is responsible for all activities carried out under his account.

6.4 By placing an order (whether as a Guest or Registered User), the User confirms that the provided personal data is complete, accurate, true and up-to-date.

7. CHOOSING AND ORDERING (BUYING) PRODUCTS

7.1 The User accepts that the purchase is carried out by selecting products based on a picture and basic description. A’MARIE does not guarantee that the colors of products are identical to the colors that the User sees on his computer screen due to screen differences.

7.2 Products are regarded as ordered at the moment the User (Buyer) completes the ordering process. Upon completion, a confirmation notice will be sent to the e-mail address provided.

7.3 If A’MARIE is not able to deliver a particular ordered product, the Buyer shall be contacted within 48 hours and informed thereof. The Buyer may always cancel the ordered product and request a refund or a replacement.

8. PRICES OF PRODUCTS

8.1 The prices of products are displayed in Euros (EUR) and include value added tax (VAT) pursuant to the laws applicable in the territory of the Republic of Croatia.

8.2 A’MARIE reserves the right to change the prices of products until the moment the purchase is confirmed.

8.3 Shipping charges are not included in the product price and are calculated at checkout based on the destination and total order value.

9. PAYMENT METHODS

Purchasing on the A'MARIE webshop is simple and secure. We offer the following payment methods:

3. Installment Payments

We offer interest-free installment payments (2-12 installments) via CorvusPay.

  • The minimum order amount for installment payments is 50,00 EUR.

  • Please note: Installment payments are available for cards issued by the following banks in Croatia:

    • PBZ

    • ZABA

    • Erste

    • RBA

4. Cash on Delivery (COD)

This option is available only for orders shipped within Croatia. You pay the total amount in cash to the GLS courier upon delivery of your package.

5. Bank Transfer

Select "Bank Transfer" at checkout. You will receive an email with payment instructions (IBAN, Reference Number). Your order will be shipped once the funds are visible in our bank account.


10. INSTALLMENT PURCHASE

10.1 A’MARIE may offer installment purchase options for specific credit cards issued in the Republic of Croatia.

10.2 The number of installments and applicable cards will be displayed at the checkout process within the CorvusPay interface.

11. DELIVERY TERMS AND SHIPPING COSTS

11.1 Delivery of products is carried out via GLS (for Croatia) and Eurosender network (for International shipping).

11.2 Shipping costs are calculated as follows:

  • Republic of Croatia:

    • Shipping cost: 7.50 EUR

    • Free shipping for orders over 149 EUR

  • European Union (EU) 

    • Shipping cost: 15 EUR

    • Free shipping for orders over 249 EUR

  • Bosnia & Herzegovina, Montenegro, Serbia:

    • Shipping cost: 15 EUR (Fixed rate)

    • No free shipping threshold.

    • Note: Delivery price does not include the costs of import clearance, customs fees, and other administrative/tax charges in the destination country. The Buyer assumes the import clearance duty and bears all related costs.

11.3 Delivery Times:

  • Croatia: up to 5-7 business days (islands may take longer).

  • International: up to 15 business days, depending on the destination.

11.4 The Registered User shall examine the parcel upon takeover. If the parcel is visibly damaged, the User should refuse to accept it and contact us immediately.

12. RIGHT OF WITHDRAWAL AND RETURNS

12.1 The User may unilaterally terminate the Contract within 14 (fourteen) days without giving reasons.

12.2 To exercise this right, the User must notify A’MARIE of the decision to terminate the Contract before the deadline by an unambiguous statement sent by post to: AMARIE DIZAJN d.o.o., Gundulićeva 19, 10000 Zagreb or by e-mail to: [email protected].

12.3 The User may use the standard Form for Unilateral Termination of the Contract available on our website, but it is not obligatory.

12.4 Refund: If the User terminates the Contract, we will reimburse all payments received from the User (excluding the costs of delivery if applicable, and ensuring the product is returned in original condition). The refund will be made without delay, and no later than 14 days from the day we receive the returned goods.

12.5 Return of Goods: The User must send back the goods to AMARIE DIZAJN d.o.o., Gundulićeva 19, 10000 Zagreb, without undue delay and in any event not later than 14 days from the day on which the User communicated the termination of this Contract. The direct cost of returning the goods shall be borne by the User.

12.6 Liability for Diminished Value: The User is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Products must be returned unworn, unwashed, and with all original tags attached.

13. CURRENCY CONVERSION

13.1 All payments will be effected in Euro (EUR). If your credit card account is in a currency other than Euro, you will be charged at the exchange rate of your credit card entity.

14. LIABILITY AND DISPUTES

14.1 A’MARIE shall not be held liable for any consequences which might arise from the unavailability of the Website for any technical reasons.

14.2 Any and all disputes which might arise from these General Terms and Conditions shall be settled before the competent court in Zagreb (Republic of Croatia).

14.3 Online Dispute Resolution (ODR): In accordance with EU regulations, disputes related to online purchasing can be resolved through the ODR platform: https://ec.europa.eu/consumers/odr/

15. CONTACT AND COMPLAINTS

15.1 In accordance with the Consumer Protection Act, if you have any objections to the purchased products or the service provided, you can send a written complaint.
